I spent some time on Saturday at the Nature Conservancy’s Lubberland Creek Preserve because I needed a photo for the “About NH Water Law” page. I chose Lubberland Creek because it is an amazing salt marsh which I helped protect in one of my cases. The case involved the Moody Point development in Newmarket, New Hampshire. The developer had promised the local planning board in 1985 that 300 to 500 foot buffers on “Lot 13” would be maintained as a wildlife sanctuary. Two years later the Town Hall burned to the ground and the management plan for Lot 13 was lost. Nearly three decades later, the owner filed an application to subdivide and develop Lot 13. The planning board denied the application and the developer appealed. Representing the Town, I petitioned the Court to allow the Town to record a development restriction based on statements made to the planning board minutes and other records.

Unfortunately, the lighting conditions were just awful. I did get a few shots but because of the low sun angles, I could not put Lot 13 in the background. However, as I learn more about web site design, I will be working with a professional photographer and will update content. Being a solo practitioner is an exciting challenge and it seems fitting to start with a few ‘selfies’.
